TourDeFIT.com® operates a fitness and wellness website that allow users to create profiles online in order to find and book fitness and wellness classes, services and events. TourDeFIT.com® is hosted in the United States. This Terms of Use Agreement constitutes legally binding terms and applies to your use of TourDeFIT.com® services. By accessing and/or using the TourDeFIT.com® services, you agree to be bound by this Agreement, whether you are a visitor and browse TourDeFIT.com® Services or use TourDeFIT.com® Services without being registered or you are a Member which means that you registered with TourDeFIT.com®. The term user refers to a visitor or a member. You are authorized to use TourDeFIT.com® services if you agree to abide by all applicable laws, rules and regulations and the terms of this Agreement. In consideration for becoming a member and/or making use of the TourDeFIT.com® services, you must indicate your acceptance of this Agreement during the registration process.

TourDeFIT.com® reserves the right to modify this Agreement at any time. Modifications shall be effective upon posting on TourDeFIT.com®. Your continued use of TourDeFIT.com® following any modification constitutes your agreement to be bound by and your acceptance of the Agreement.

1. Eligibility. By using TourDeFIT.com® services, you represent and warrant that (a) all registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information; (c) you are 13 years of age or older; and (d) your use of the TourDeFIT.com® services does not violate any Applicable Law. Your profile may be deleted and your membership may be terminated without warning, if we believe that you have misrepresented yourself.

2. Term. This Agreement and any posted revision to this Agreement shall remain in full force and effect while you use TourDeFIT.com®. You may terminate your membership at any time. TourDeFIT.com® may terminate your membership at any time, for any or no reason, with or without prior notice or explanation, and without liability.

3. Password. When you sign up to become a member, you will be asked to create a password. You are responsible for maintaining the confidentiality of your password. You agree to notify TourDeFIT.com® if you suspect any unauthorized use of your account or access to your password. You are solely responsible for any and all use of your account.

4. Use by Members. Illegal and/or unauthorized use of TourDeFIT.com® services is prohibited. TourDeFIT.com® reserves the right to take appropriate legal action for any illegal or unauthorized use of the TourDeFIT.com® services.

5. Proprietary Rights in Content on TourDeFIT.com®. TourDeFIT.com® does not have the right to sell or otherwise distribute your content outside of the TourDeFIT.com® services or linked services. The TourDeFIT.com® Services contain content of TourDeFIT.com®. TourDeFIT.com® content is protected by copyright, trademark, patent, trade secret and other laws, and TourDeFIT.com® owns and retains all rights in the TourDeFIT.com® content and the TourDeFIT.com® Services.

6. Third Party Linked Services. Linked services created by third party developers may be available on, through or in connection with TourDeFIT.com® services. When you engage with a third party Linked service, you are interacting with the third party, not with TourDeFIT.com®. TourDeFIT.com® does not control the third party, and cannot dictate their actions. If you choose to use a third party Linked service, the linked service may use and share your data in accordance with their privacy policy of and your privacy settings on such service. TourDeFIT.com® is not responsible for third party linked services or the providers of such linked services. TourDeFIT.com® encourages you not to provide personal information to third party linked services unless you know with whom you are interacting.

7. Member Disputes. You are solely responsible for your interactions with other TourDeFIT.com® users, third party developers or any other parties with whom you interact through the TourDeFIT.com®. TourDeFIT.com® reserves the right, but has no obligation, to become involved with disputes.

8. Privacy. Use of the TourDeFIT.com® services is governed by our Privacy Policy, which is incorporated into this Agreement by this reference.

9. Disclaimers. TourDeFIT.com® is not responsible for and makes no warranties, express or implied, as to the user content or the accuracy and reliability of the user content posted through or in connection with the TourDeFIT.com® Services or linked services. TourDeFIT.com® is not responsible for any damage, injury or loss caused by Users of the TourDeFIT.com® services. TourDeFIT.com® takes no responsibility for third party advertisements or linked services posted on TourDeFIT.com®, nor does it take any responsibility for the services provided by these third parties. TourDeFIT.com® is not responsible for, and you will not hold TourDeFIT.com® responsible for, any injuries or illnesses that arise from your use of the services or facilities, or your participation in any events, provided by or through the gyms, spas, studios, events, etc. listed on, or for which you sign up for on, TourDeFIT.com®.

10. Limitation on Liability. IN NO EVENT SHALL TourDeFIT.com® BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING, WITHOUT LIMITATION, LOST PROFIT DAMAGES ARISING FROM YOUR USE OF THE TourDeFIT.com® SERVICES OR LINKED SERVICES.

11. Disputes. The Agreement shall be governed by, and construed in accordance with, the laws of the State of Georgia, without regard to its conflict of law provisions. You and TourDeFIT.com® agree to submit to the exclusive jurisdiction of the Fulton County Superior Court located within the State of Georgia to resolve any dispute arising out of the Agreement or the TourDeFIT.com® services.

12. Other. This Agreement is accepted upon your use of the TourDeFIT.com® services. Your access and use of certain TourDeFIT.com services will require you to accept additional terms and conditions applicable to such certain TourDeFIT.com® services.
